Part 74 establishes design, performance, testing and approval requirements for coal mine dust sampling devices. Continuous personal dust monitors provide within-shift and end-of-shift measurements, while other sampler units follow a distinct technical pathway. The approval process involves MSHA and NIOSH. An approved instrument supports exposure measurement; it does not by itself establish that a mine's dust-control program or sampling practice complies with all applicable rules.
The regulation distinguishes a coal mine dust personal sampler unit from a continuous personal dust monitor. The former includes a pump and sampling assembly; the latter continuously measures respirable dust and reports exposure information during and after a shift. Determine the required sampling function before selecting equipment. A general-purpose optical particle meter or environmental air-quality sensor should not be represented as interchangeable with an approved coal mine sampling device.
For continuous monitors, Subpart C addresses design and construction, measurement accuracy, reliability, quality assurance, instructions and testing. The measurement requirements concern the respirable dust application under specified conditions. Sensitivity alone does not describe an instrument's suitability; bias, precision, flow performance and environmental effects can influence the result. The approved design and prescribed test framework provide the basis for comparing the instrument with the regulatory requirements.
Part 74 sets application requirements for drawings, specifications, materials and supporting test information. Continuous-monitor applications involve both NIOSH and MSHA, with the agencies addressing their respective responsibilities. Approval follows the prescribed testing and review, rather than an unsupported supplier declaration. The product file should preserve the certificate and the associated list of design documents so later production units can be traced to the construction that was evaluated.
The continuous-monitor provisions require a quality control system and specify incorporated quality-system requirements. The edition identified in the regulation must be distinguished from whatever newer edition a manufacturer ordinarily uses for its commercial certification. Manufacturing changes affecting sensing components, flow systems, firmware or enclosure protection need review against the approved design. A general quality-management certificate does not replace the device-specific approval or its performance evidence.
Operating and maintenance instructions form part of the device framework. The user should preserve the approved configuration and follow the applicable servicing and verification procedures so measurements remain meaningful. For a quality program, connect each result to instrument identity, operating status and the sampling conditions. A numerical display without that context cannot establish whether the measurement is suitable for a particular compliance determination.
The device approval rule and the rules governing workplace sampling answer different questions. Approval addresses the instrument; sampling provisions determine who, where, when and how exposure is measured and what actions follow. Selection should therefore be coordinated with the applicable coal mine dust requirements and the operator's sampling program. Avoid presenting a monitor purchase or approval label as proof that dust concentrations, controls or individual exposure conditions are acceptable.
