Inspection of Fixed-Price Government Supplies

FAR 52.246-2 addresses inspection of supplies under fixed-price contracts in which the clause is included. It assigns contractor quality responsibilities and government inspection and acceptance rights. A supplier should connect the clause to the actual contract, technical requirements and acceptance arrangements rather than treating government inspection as a replacement for its own control of production.

Legal character
A federal contract clause that governs when incorporated into the applicable contract; it is not a general market-access rule for all products.

Confirm the clause in the contract

Review the signed contract and its modifications to determine whether this clause applies and which supplies it covers. Contract definitions and other clauses can affect interpretation. The presence of the clause in the FAR website is not evidence that it governs a particular commercial order. Identify the contracting authority and the controlling contract documents first.

Maintain the contractor’s inspection system

The clause addresses an inspection system acceptable to the government and records of inspection work. Contractor responsibilities continue even where government personnel inspect or test supplies. NCQM practice consideration: map technical acceptance requirements to inspection stages, methods and records so that production personnel can show how conformity was established before offering the supplies.

Plan access and inspection conditions

Government inspection and testing rights can affect facilities, assistance and the availability of supplies for examination. Review the actual contract for source or destination arrangements and notice requirements. Plan hold points with the production sequence. An unplanned inspection after packaging or assembly can leave critical characteristics inaccessible and create avoidable questions about acceptance evidence.

Handle nonconforming supplies explicitly

The clause addresses rejection and the correction or replacement of nonconforming supplies, subject to its terms. Maintain identification and control of rejected material. A request for government acceptance of a departure requires the appropriate contractual route; an internal concession does not automatically change the government’s acceptance requirements.

Keep acceptance distinct from surveillance

NCQM practice consideration: identify who has authority to accept supplies and what record establishes acceptance. A government visit, witness signature or absence of an objection may have a different meaning from formal acceptance. Preserve the technical results and contractual acceptance record separately, with references that connect both to the delivered lot or item.

Review the complete quality arrangement

Inspection clauses operate with specifications, warranty provisions, quality requirements and other contract terms. Read them together and resolve conflicts through the authorized contract process. Do not describe the clause as a government product certification or use a completed contract as unrestricted approval of future supplies. Each delivery remains tied to its governing requirements.
