Research on defined product requirements and the use of standards in India. Each record identifies its scope, source and practical evidence questions.
Market scope
Each QCO, date, exemptions and scheme requires current verification.
The records below examine specific provisions and standards relationships. They do not combine different products or regulatory roles into one approval route.
A compulsory BIS duty needs a section 16 notification, not merely an Indian Standard title
Bureau of Indian Standards Act 2016 · Section 17(1), read with section 16(1)
Section 17(1) restricts manufacture, import, distribution, sale and the other listed activities for items notified under section 16. It also prevents a licence holder applying the Standard Mark to nonconforming goods. A valid licensing route and conformity are separate conditions: a licence is not permission to release any model or specification. The triggering QCO determines whether the particular product is within the compulsory regime.

Applies to
Goods, articles, processes, systems or services actually brought within a section 16 compulsory notification.
Scope and conditions
Publication of an Indian Standard alone does not establish this compulsory trigger.,The relevant QCO, scheme, implementation date and exemptions must be resolved for the actual product.
Actions
Identify the operative section 16 notification and exact product description.
Resolve the correct licensing/conformity-assessment scheme and operative dates.
Ensure both lawful marking and conformity before the covered activity.
Evidence identified by the source
Valid licensing or conformity documentation required by the particular notified route.

Model and manufacturing-unit correspondence with the actual licence.
Toy QCO conformity and marking remain product-specific, including the 2026 permission route
Toys (Quality Control) Order 2020 and Transition Facilitation (Quality Control) Order 2026 · Toy Order paragraph 3; 2026 Order paragraphs 2-4 and Schedule
Paragraph 3 requires covered toys to conform to the corresponding Indian Standards and bear the Standard Mark through the ordinary Scheme I licensing route. The 2026 facilitation order lists toys and permits a specific Scheme II route only for manufacturers supplying a person granted the required DPIIT permission. That order preserves conformity to the applicable standards. A supplier must therefore identify its actual authorised route, not infer general deregulation from the word transition.

Covered toys designed or clearly intended for play by children under 14, subject to the operative exclusions and permitted routes.
Scope and conditions
The toy QCO contains an export exclusion and subsequent amendments must be checked for other exceptions.,The 2026 alternative is permission-dependent; it is not a blanket waiver of toy conformity or marking.
Actions
Classify the toy and corresponding QCO standard set.
Establish ordinary Scheme I compliance or the specific permission and linked Scheme II route.
Maintain conformity and model/unit traceability under the route actually used.
Evidence identified by the source
Applicable BIS licence and Standard Mark.
Specific DPIIT permission where the 2026 alternative is claimed.

Medical-device standard selection follows the Rule 7 hierarchy
Medical Devices Rules 2017 · Rule 7, as explained in CDSCO FAQ questions 25-26
CDSCO's explanation of Rule 7 requires the relevant BIS product standard where one exists. Where no relevant BIS standard exists, the hierarchy proceeds to the stated international or pharmacopoeial standards and, where none are available, a validated manufacturer standard. The technical file should therefore explain the selection process, rather than list whichever international report a supplier already possesses. The QMS and product-standard questions remain distinct.

Medical devices within the Indian Medical Devices Rules, with the relevant product standard selected for the device.
Scope and conditions
An ISO certificate does not displace an available applicable BIS product standard.,A manufacturer-standard route arises only when the preceding applicable standards are unavailable; its validation must be established.
Actions
Search for the relevant BIS product standard for the defined device.
Document the permitted fallback only where the preceding applicable standard is absent.
Validate any manufacturer standard used through the final fallback route.
Evidence identified by the source
A validated manufacturer standard where that Rule 7 fallback is used.

The front-of-pack food name must convey the product's true nature
Food Safety and Standards (Labelling and Display) Regulations 2020 · Regulation 5(1)
Regulation 5(1) requires the food name on the front of pack to indicate the true nature of the food. A prescribed name is used where the food has a regulatory compositional identity; otherwise a common/usual name or accompanying true-nature description is used. A marketing brand alone does not perform this identification function. This record addresses the name-of-food requirement, rather than all nutritional, non-retail or specialised label requirements.

Rule 6(1)(a) requires the relevant manufacturer/packer information and importer information for an imported package. The department's FAQ specifically addresses why a marketed-by or brand-owner address is not by itself a substitute. The review should identify the legally relevant roles in the actual supply chain, then compare them with the declarations on the sold package. This is separate from product registration or general brand ownership.

Imported cosmetics require registration before import unless a specific exception applies
Cosmetics Rules 2020 · Rule 12(1)
Rule 12(1), as explained by CDSCO, requires imported cosmetics to be registered with the Central Licensing Authority before import. Registration is linked to the cosmetics and manufacturing premises covered by the process, rather than the importer's brand claim alone. New cosmetics involve a separate prior-permission question. The practical review starts with the product's intended purpose, the manufacturing site and the exact coverage of the registration.

BIS identifies IS/ISO 13485:2016 as an identical adoption
BIS MHD 7 published-standard work programme
The BIS committee work programme lists IS/ISO 13485:2016 and identifies the adoption as identical under the stated numbering arrangement. This establishes the relationship for the selected 2016 publication. Regulatory use must still be tied to the particular medical-device provision, application or accepted evidence route. A certificate covering an organisation's QMS should not be described as proof that each product meets all Indian product requirements.

IS/ISO/IEC 17025:2017 preserves the international laboratory-competence identity
BIS national adoption identity for laboratory competence
BIS's official publication information describes IS/ISO/IEC 17025:2017 as identical with ISO/IEC 17025:2017 and adopted through the CASCO national mirror structure. This relationship concerns the laboratory competence standard. It does not establish a laboratory's current accreditation, nor does it mean that every product rule accepts any report bearing the designation. The standard identity and the laboratory's actual method scope are separate review objects.

The toy QCO selects named IS 9873 parts rather than a generic international toy certificate
Toys (Quality Control) Order 2020: selected Indian standards
The toy QCO's table identifies the Indian standards associated with the covered toys, including IS 9873 Part 1 and other listed safety subjects. That statutory selection is distinct from an assertion that any ISO or EN toy report is acceptable. The current BIS listing also points to amendments and transition arrangements, so the report-edition decision must be tied to the actual licensing route and applicable product category.

Indian ICT registration migrates to IS/IEC 62368 Part 1 with different concurrency dates
Migration to IS/IEC 62368 Part 1:2023 under the Electronics and IT Goods Registration Order
The 2025 notification substitutes IS/IEC 62368 Part 1:2023 in the stated entries of the 2021 registration order and adds extended-reality products. It permits the older references concurrently until 1 May 2026 for serial 65, while the other affected goods have concurrency until 1 November 2028. These are different legal timelines; neither the national standard's publication year nor a generic migration announcement settles the product-specific date.
